Terms of Service

These Terms of Service ("Terms") govern the use of the website and services provided by Sierra Vista Media ("we", "us", "our"). By accessing or using www.sierravistamedia.com, you agree to be bound by these Terms.

Payment Terms

Clients have the opportunity to review and approve all media before final payment. However, all media produced by Sierra Vista Media must be paid in full prior to use on any platform. Once payment is received (via cash, credit card, check, etc.), the media is released for unrestricted use according to the agreed-upon licensing terms.

After the initial photo shoot, Sierra Vista Media will provide up to 15 proof images for quality review. By approving these proofs and submitting payment, the client acknowledges that the delivered media meets their expectations. Due to the nature of digital media production, no refunds will be provided once the client has accepted the proofs and completed payment.

If Sierra Vista Media commits to a scheduled shoot, completes the work, and the client declines to pay for any reason, a $150.00 minimum fee will be charged to cover time, travel, and labor — regardless of whether the client chooses to use the media.

In the event of non-payment, late fees will apply as follows:

2% of the total project cost if payment is more than 7 days late
5% of the total project cost if more than 14 days late
10% of the total project cost if more than 30 days late

Sierra Vista Media reserves the right to pursue legal remedies, including the use of a collections process, to recover unpaid invoices and late fees.

Rescheduling & Cancellation

Sierra Vista Media does not charge fees for rescheduling or cancellations, even if we arrive on-site and the shoot is not ready. We understand that unforeseen circumstances may arise and strive to work collaboratively with you to ensure a seamless process.

All media created by Sierra Vista Media is protected under U.S. copyright law, with full copyright ownership retained by Sierra Vista Media unless explicitly transferred through a written agreement.

Clients who have paid in full are granted a non-transferable, limited-use license to use the media exclusively for marketing the specified property. This license permits use in both digital and print formats for the duration of the property's active listing. Any reuse, transfer, or use beyond the initial scope requires prior written permission from Sierra Vista Media.

Additional Licensing

The media provided by Sierra Vista Media is licensed for use in MLS listings and related online real estate marketing. If you wish to use the media for purposes beyond the original scope—such as magazine features, commercial promotions, re-listings, or new marketing campaigns—written permission from Sierra Vista Media is required. Additionally, any published media used outside of MLS listings must include credit to Sierra Vista Media alongside the image. Please contact us to discuss additional licensing options.

COMPLIANCE WITH ADVERTISING STANDARDS AND DIGITALLY ALTERED MEDIA LAWS (ARIZONA)

SIERRA VISTA MEDIA PROVIDES PROFESSIONAL PHOTOGRAPHY, VIDEOGRAPHY, AND POST-PRODUCTION SERVICES, WHICH MAY INCLUDE STANDARD IMAGE CORRECTION AND, WHEN REQUESTED, DIGITALLY ALTERED OR AI-ASSISTED ENHANCEMENTS SUCH AS VIRTUAL STAGING, OBJECT REMOVAL, SKY REPLACEMENT, LAWN ENHANCEMENT, LIGHTING MODIFICATION, OR SIMILAR VISUAL CHANGES.

THE CLIENT ACKNOWLEDGES THAT THE STATE OF ARIZONA, LOCAL MUNICIPALITIES, REAL ESTATE BOARDS, MULTIPLE LISTING SERVICES (MLS), AND PROFESSIONAL ASSOCIATIONS MAINTAIN INDEPENDENT AND EVOLVING RULES REGARDING THE DISCLOSURE OF DIGITALLY ALTERED IMAGES.

SIERRA VISTA MEDIA DOES NOT DETERMINE MLS COMPLIANCE OR DISCLOSURE REQUIREMENTS.

IT IS THE SOLE RESPONSIBILITY OF THE CLIENT AND/OR LISTING BROKER TO ENSURE THAT ALL IMAGES, VIDEOS, AND MARKETING

BY ACCEPTING AND USING THE DELIVERED MEDIA, THE CLIENT ASSUMES FULL RESPONSIBILITY FOR COMPLIANCE AND AGREES TO INDEMNIFY AND HOLD HARMLESS SIERRA VISTA MEDIA, ITS OWNERS, EMPLOYEES, AND CONTRACTORS FROM ANY FINES, CLAIMS, PENALTIES, DISCIPLINARY ACTIONS, OR LEGAL PROCEEDINGS ARISING FROM USE OF THE MEDIA.

Changes to This AgreementSierra Vista Media reserves the right to modify these Terms at any time. Any changes will be posted on this page, and the revised Terms will take effect immediately upon posting.
